The MP3s available for download on this blog are from collections of western swing 78s and Radio Transcriptions donated by a small group of devoted collectors. Our main purpose is to share and introduce to others this great and mostly unknown music. Here at WS on 78 we try not to post music that's available for purchase. So please don't request any CDs. And please support the Western Swing music labels by purchasing their CDs.
All downloads are free and compiled as ZIP or RAR files and need to extracted with Winzip, Winrar or any similar software.

LP Posts Removed

Hello all, I got a warning from Blogger about copy right infringement for one of the out of print LPs I was sharing. Someone complained so I removed all LPs posts just to be safe. I sorry if the post in question upset the original source of the LP. I'll be happy to remove any questionable posts. Just email me and they are gone with my apologies. That goes for the 78s I post as well, I don't want to post 78s that are available on CD. If necessary I would be willing to close the blog. I want to promote western swing CD production not hurt it.

HFN, you are the King of Western Swing (Internet Division). I don't think there's anyone else who keeps such a pure blog. Please keep on doin' what you're doing.

Lonesome Lefty had the same problem , just some bored person causing problems , don't get discouraged I do love the old radio transcripts .

Love the blog.
I was always under the impression that it was the obligation of the copyright holder to claim infringement.
I'd suspect that many of these older LPs would fall under orphaned works.

It really would be a shame if you have to shut down the blog. A lot of real treasures have been posted here that I would never have heard otherwise.

I know this is a long comment, but it's a worthwhile one:
A lot of music blogs are going private. They are allowed to invite up to 30 people.
On the private blog I belong to, almost everyone posts and shares their recordings.
It's very friendly and there are no outside hassles because it's private.
I'm the only one posting OTR transcriptions along with different kinds of music from my collection (I just posted Eddy Albert's Checkerboard Fun Fest transcriptions with The Cackle Sisters). Everyone posts different types of music, and we try to add to each others collections if we have things they need.
You've had quite a collection here for a while, and I've come back every so often to see what you've added. It would be better for you to go private and keep your collection as is, especially because music blogs that handle transcriptions and 78s are rare now.
So, you should keep going.
What you've been posting is public domain, even by US standards. There should be no complaints as long as you're not taking the material from an in-print reissued CD -- and even then, if you take the same material from lacquer 78s or vinyl, they shouldn't have anything to complain about because it's not the same as what they're selling.
Before you go private, you can go through the comments sections of your posts to determine the regular visitors who leave comments for you. Clicking on their screen names should take you to their blogger profiles and their e-mail addresses, if they chose to make those public. You'll be able to send 30 invitations that way after you switch over to private status. And remember to include your contributors, because if everybody posts, it's actual music sharing (and all the burden isn't on one person).
The private blog that I got invited to hasn't been up for a long time, but it's already an ideal example of what music sharing is supposed to be. They just set up a chat room section last night, and there are different pages for leaving different kinds of information comments -- that's how I found out you'd had some trouble (someone left a comment). I haven't visited your blog for a while (since sometime last year or so -- I had another blogger photo; now I'm a kid with a record player), but I came over to type in some encouragement.
FYI: Here's one of the "music nazi" groups (it's their English page):

They call themselves The Belgian Anti-Piracy Federation (BAF) and they're connected/have contact with other organizations throughout Europe and North America that have other names. They like to "hit" old posts of vinyl, although we really can't figure out what their criteria is; one guy got hit over an old budget cha-cha LP from the early 1950s (public domain). I don't have the other groups names and addresses handy, or I'd leave those for you, too, so you could do some research.
Anyway, seriously consider going private instead of removing posts or shutting down. You've been serious about what you're doing, so just keep going.
And I better get these Cliffie Stones while you're still public! So, if I don't get to visit you later because you went private, best of luck. Just don't stop.

Thanks everyone, right now I don't plan on closing the blog. I'm just going to post 78s and stay away from LPs. Going private will be a last resort. Because my main reason for the blog is to introduce western swing a private blog would be counterproductive.

KL from NYC is ill-informed about what constitutes "public domain" and should not be providing legal advice on the subject. I'm a collector of vinyl as well as a DJ at a non-profit FM radio station and we deal with intellectual property law on a daily basis. Our broadcast license depends on our compliance with federal copyright law. Just because something is older than you doesn't put it in the public domain.

Do your research. Right now. Open up a new browser window, type "wikipedia.org" in the address bar, search for "expiration of copyright" and you will get the following results for the United States:

Copyright terms based on authors' deaths: Life + 70 years (works published since 1978 or unpublished works)

Copyright terms based on publication and creation dates: 95 years from publication or 120 years from creation whichever is shorter (anonymous works, pseudonymous works, or works made for hire, published since 1978); 95 years from publication for works published 1964–1977; 28 (if copyright not renewed) or 95 years from publication for works published 1923–1963; Copyrights prior to 1923 have expired.

That being said, I really like your blog. Keep up the good work.

It's strange that you're "anonymous" -- because that's exactly how the anti-piracy fanatics leave their comments. And, your comment is curiously similar (almost exact) to one left at another music blog less than a year ago -- also "anonymous."
Funny, huh? (Not really.)

I did not provide legal advice, but I did suggest that he consider making his blog private so that the people who actually do enjoy the music can continue to share it without violating any laws.

Blogger allows 100 contributor and 100 guest for a total of 200 invitations.
